Conference on outcomes of Awareness Program on Commercial Laws and Discussions of relevant entities on challenges arising out of these Laws

The fundamental core stone of any society is   the  economy and the commercial Laws laid down; following these laws is not  only   duties and responsibilities of relevant  entities   but   also    private    sector entrepreneurs and the whole nation.

Lack of awareness about commercial laws has been  one of the main challenges faced by the trade  community  members.  As   a   result, ACCI  with  the  financial  cooperation  and  support   of   Afghanistan Investment Climate Facility  (Harakat - AICF)    and  in   coordination  with  relevant  government  entities  took   the initiative to organize an Awareness program  on  Commercial   Laws   to   trade   community members in provinces like Kabul, Balkh, Kunduz, Herat, Nengarhar, Kandahar and Khost.

The program continued for 5 months, the  chapters  included  in   the program   were   mainly; Tariff Legislation Law, Anti monopoly   Law,  Anti   Hoarding   Law,   Arbitration   Law   and Contract Laws  where more than 1470 private sector’s traders and entrepreneurs took  the chance to participate.

On Thursday 25 February 2010, ACCI hosted  a conference for the same purpose on announced the key results and achievements of the program likewise discussions on legal or practical challenges arising out of these laws in presence of official delegates of ministries of commerce and industries, Finance, Justice, Economics, MPs, supporting international organizations and around 250 traders and entrepreneurs from all over the county.

Mohammad Qurban Haqjo in his welcoming speech while addressing the participants said that Afghanistan almost in every sector particularly in economic and commercial areas have got strong laws but, unfortunately problems exist in implementing these laws where in most of the public organizations, these laws get implemented for personal benefits.

According to Haqjo” improper implementation of laws causes lack of coordination between public and private sector in continuing economic affairs of the country, mean while, unawareness of the traders from the commercial laws of the country even causes negative attitudes towards Market Economy which is a point of concern for the private sector”.

 

Furthermore, H.E Ghulam Mohammad Eilaqi Minister of Commerce and Industries in his opening speech while counting the Awareness Program on Commercial Laws and discussions on challenges arising out of these Laws as an important initiative by ACCI, added,” in the last 8 years we have draft and developed 13 laws out of which 7 got approved and implemented. Though we have got strong laws, we have weaknesses in implementing these laws and solving these challenges requires practical steps.”

  

Finally, Mr. Suleman Fatimie Chief Executive Officer to Harakat while expressing Harakat’s long term support in establishing an effective climate for investment reforms added,” taking in to consideration its 8 priority focus areas, Harakat supports Afghanistan’s public and private sector in developing a consistent economic reform and tackling challenges”.

HARAKAT is a new and unique independent entity, funded by donors and the private sector, and designed to address key constraints affecting private sector-led growth in Afghanistan. The mission of the HARAKAT is to make Afghanistan a better place to do business by removing obstacles to private and domestic investment. The HARAKAT will be a proactive and responsive grant facility leveraging resources from the private sector against contributions from major donors.

ACCI as a supportive entity of private sector activities has always vested its activities in analyzing the challenges faced by the private sector community. Moreover, in order to attain economic growth and development of the county, ACCI has always been in close coordination and support with the government entities in organizing and implementing economic policies and strategies.

The main objective behind organizing Awareness Program on Commercial Laws is not only to address the expectations of private sector entrepreneurs from the relevant public entities but  the ways and means of solving these challenges faced by the economic growth and development particularly trading activities of the country.
